Terms of Service & Sale
Last updated: 2026-05-08 · v1 draft
These terms govern your access to and use of autocrypto.space, the AutoCrypto MCP server, the official installer (autocrypto-setup), and the AutoCrypto Pro subscription. By using any of those, you agree to what's below.
1. Definitions
- Publisher, we, us: Backroom Inc., the company operating AutoCrypto. See Legal mentions.
- Service: the AutoCrypto website, MCP server, installer, skills, and the optional Pro subscription.
- User, you: any person who installs, accesses, or uses the Service.
- Wallet: the user's self-custodied crypto wallet (e.g. MetaMask, Rabby, Coinbase Wallet) plus the associated Safe execution walletdeployed on Base.
- Pro subscription: the paid tier of the Service ($9.99/month or $95.88/year) that unlocks on-chain trade execution.
2. Nature of the Service — what AutoCrypto is and isn't
AutoCrypto is a wallet control layer: a software interface that lets an AI assistant the user already runs (Claude, Cursor, Windsurf, or any compatible client) call a bounded set of tools that read the market, propose trades, and — with the Pro subscription — execute trades from the user's Safe wallet on Base, within rules the user sets.
AutoCrypto is not:
- a custodian, broker, dealer, exchange, market maker, or money transmitter;
- a financial advisor, investment advisor, or asset manager;
- a payment service provider, e-money issuer, or remittance service;
- regulated as a Crypto-Asset Service Provider (CASP) under MiCA at the time of v1.
No content on the Service constitutes financial, legal, tax, or investment advice. Crypto assets are volatile, and you may lose all of your funds. You alone are responsible for evaluating whether the Service is appropriate for you.
3. Eligibility
To use the Service you must:
- be at least 18 years old (or the age of majority in your jurisdiction);
- have the legal capacity to enter into binding contracts;
- not be a resident of, or located in, a jurisdiction where access to crypto-asset services is prohibited or restricted in a way the Service cannot accommodate;
- not be subject to applicable sanctions (including OFAC, EU, or UN sanctions lists);
- not use the Service for money laundering, terrorism financing, market manipulation, or any other unlawful purpose.
AutoCrypto does not perform identity (“KYC”) checks itself; on-ramps and off-ramps used to fund or withdraw from your wallet may. You are responsible for complying with the rules of those services.
4. The user's wallet — non-custodial throughout
The Service is non-custodial. Funds always live in:
- your source wallet, which you control through your wallet provider; AND
- a Safe execution wallet on Base, deployed by you, signed by your source wallet, and bounded by on-chain rules and AutoCrypto policies.
We never see your seed phrase, never hold your private keys, and cannot move your funds outside the Safe's scope. You are solely responsible for the safekeeping of your seed phrase and credentials.
5. Bounded execution — what the agent can and can't do
When you use the Service, the AI assistant can call AutoCrypto tools to:
- read public market data,
- read your wallet's balances and on-chain history,
- propose trades within the risk style and budget you have set,
- execute trades through the Safe wallet, only when (i) you are on a Pro subscription, (ii) the trade satisfies your active risk policy, and (iii) the market conditions match a triggered entry or exit rule,
- pause and resume trading at your request.
The agent cannot withdraw funds outside the Safe scope, change your risk policy without your consent, or execute trades exceeding your configured limits.
6. Free tier
The Free tier is offered without time limit. It includes everything in the Service except on-chain trade execution (execute_trade). Free users can install, connect a wallet, run simulations, view recommendations, and use all read-only tools.
7. Pro subscription — sale terms
The Pro subscription unlocks execute_trade for on-chain trades.
- Price: US$9.99 per month, or US$95.88 per year (a 20% discount). Prices may be displayed in your local currency. Stripe handles conversions.
- Billing: Subscriptions are managed by Stripe. Stripe is the merchant of record for these transactions.
- Renewal: Subscriptions renew automatically until cancelled.
- Cancellation: You can cancel anytime through the Stripe customer portal or by contacting contact@autocrypto.space. Cancellation takes effect at the end of the current billing period; the agent reverts to Free (read-only) at that point.
- Refunds: Charges are non-refundable except where required by applicable law. EU/EEA consumers retain the right of withdrawal under the Consumer Rights Directive (Directive 2011/83/EU) where applicable; by starting to use the Pro subscription you may waive this right per Article 16(m).
- Taxes: Prices may exclude VAT or sales tax. Stripe collects and remits applicable taxes when required.
We may change pricing with at least 30 days' notice; existing subscribers will be renewed at the previous price until the next billing cycle following that notice.
8. User obligations
You agree:
- to keep your wallet credentials secure;
- not to interfere with the Service, attempt to bypass guardrails, or reverse engineer the MCP server beyond what applicable law permits;
- not to use the Service to facilitate prohibited activities (Section 3);
- to comply with the terms of every third-party service involved (your AI provider, Stripe, Safe, your wallet provider, the on-ramp/off-ramp you use);
- to declare and pay any tax due on gains realized through the Service.
9. Risks you accept
By using the Service you acknowledge:
- Market risk: crypto-asset prices can drop sharply and remain depressed indefinitely. You may lose part or all of the funds in your Safe.
- Smart contract risk: Safe contracts, ERC-20 tokens, and the Base network may contain bugs or vulnerabilities.
- Network risk: Base or its sequencer may experience downtime, re-orgs, or fee spikes; transactions may fail or be delayed.
- AI risk: the AI assistant you use may misinterpret a request, hallucinate data, or recommend a trade you did not want; the AutoCrypto tools limit blast radius but do not eliminate this risk.
- Operational risk: the Service may be temporarily unavailable; we do not commit to a specific uptime SLA in v1.
10. No warranties
The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors, or that any signal, recommendation, or trade will be profitable.
11. Limitation of liability
To the maximum extent permitted by law, the Publisher will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of crypto assets, arising out of or in connection with your use of the Service.
For any direct damages we are found liable for, our aggregate liability is limited to the greater of (a) US$100 or (b) the amount you paid us in the twelve months preceding the event giving rise to liability.
Nothing in these Terms excludes liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
12. Third-party services
The Service depends on third parties: Stripe (payments), Safe (custody contract), Base/Coinbase (blockchain), your wallet provider, and your AI provider. Each carries its own terms and responsibilities. We are not liable for failures, downtime, or losses caused by those services. See Legal mentions for the full list and links.
13. Personal data
We process the minimum personal data needed to operate the Service: wallet address (public, on-chain), email (optional, for billing receipts), and product telemetry (anonymous unless tied to a wallet binding). We do not sell personal data.
Under the GDPR (and equivalent laws), you have rights of access, rectification, deletion, restriction, portability, and objection. Requests: contact@autocrypto.space.
Card details are handled exclusively by Stripe, a PCI DSS Level 1 service provider.
14. Termination
You may stop using the Service at any time and uninstall the AutoCrypto MCP entry with npx autocrypto-setup --uninstall. Your wallet, Safe, history, and on-chain records remain entirely under your control.
We may suspend or terminate your access if you breach these Terms, attempt to harm the Service or its users, or if required by law. Where reasonably possible we will provide prior notice.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via the Service and (where we have your email) by email. Continued use of the Service after a change takes effect constitutes acceptance.
16. Governing law & disputes
These Terms are governed by the laws of France. The competent courts of Paris, France have exclusive jurisdiction, subject to mandatory consumer-protection rules that grant you the right to bring proceedings in your country of residence.
EU consumersmay also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
